[VAW 2023] Management of risks & disputes in prominent energy projects - toward sustainable energy development in VIetnam

Disputes in the energy sector present a range of challenges for stakeholders in the industry. Construction and energy sector disputes undeniably dominate international arbitration both in number and value, with the highest value arbitral awards arising from arbitrations in these fields. Furthermore, policy and regulatory risks appear to represent a major barrier for renewable energy investments, while at the same time, insurance coverage or alternative risk mitigation is strongly limited. This emphasizes the need for new risk transfer solutions to ensure a sustainable growth of renewable energy. Vietnam is also on the list of countries with great potential to invest in new renewable energy sources such as solar, wind power, biomass electricity, dual-sea electricity and Biogas in addition to available energy sources such as Liquefied Natural Gas, Hydroelectricity and coal power. Taking advantage of the existing potential, management of risk and disputes resolution in the energy sector is the way toward sustainable energy development in Vietnam.
