ACLA representatives speaking at the meeting

On behalf of ACLA, Mr. Trinh Thu Thai – Vice President of ACLA, provided an overview of the Association. Established in 1985, the Association now comprises of 883,000 lawyers and more than 20 functional departments. It plays an important role in supporting the Chinese Government in law-making and implementation, promoting judicial reform, and advancing the legal profession. On the occasion of the 75th anniversary of Vietnam-China diplomatic relations (January 18th, 1950 – January 18th, 2025), he emphasised the long-standing tradition of close and multilateral cooperation between the two nations.

Mr. Thai expressed his admiration for the scale and effectiveness of VIAC’s operations, particularly noting that 28.22% of its cases involve international disputes and 19.72% involve at least one foreign direct investment (FDI) enterprise, with Chinese enterprises ranking first among foreign parties in VIAC cases. He also highly appreciated the active and professional participation of Chinese arbitrators and mediators at VIAC.

Following this, Mr. Khuong Quoc Dong – Deputy Secretary-General of ACLA and Secretary-General of the Belt and Road Legal Services Forum, stated that the Forum is promoting cross-border legal cooperation through a network of lawyer organisations and dispute resolution bodies across economies along the economic corridor. With many leading international arbitration centres located in China, he underscored the significant potential for closer cooperation between VIAC and regional legal mechanisms, especially in international commercial dispute resolution.

The working session continued with comments and insights shared by ACLA delegates on the rapid development of arbitration and commercial mediation in China in recent years, including the adoption of a combined arbitration - mediation model similar to that of VIAC. Regarding legal areas with newly emerging approaches, such as intellectual property (IP) and ESG, ACLA highlighted the growing need for enhanced information-sharing and experience-exchange to support businesses in adapting effectively to the evolving landscape. During the discussion, representatives of VIAC and ACLA agreed that cooperation between dispute resolution institutions and professional lawyer organisations plays a pivotal role in fostering a healthy and sustainable legal ecosystem. Both sides also identified several potential directions for collaboration, including joint training and expert capacity-building; regular exchanges on legal developments and adjudicatory practices; and coordinated support for Vietnamese and Chinese enterprises in strengthening risk management, preventing disputes, and accessing effective ADR mechanisms.

Overview of the meeting

The meeting concluded in an open and cordial atmosphere, with multiple perspectives exchanged, reaffirming both sides’ commitment to strengthening professional cooperation and promoting friendly, transparent, and effective dispute resolution mechanisms. This, in turn, contributes to reinforcing economic and legal relations between Vietnam and China in the new phase of development.
