During the working session, representatives of VIAC and NO&T discussed the practice of resolving disputes through commercial arbitration at VIAC, as well as considerations regarding cases involving Japanese parties at VIAC. This served as an opportunity for VIAC to strengthen its connections while sharing expertise and experience with international lawyers, while also assisting Japanese lawyers in enhancing their understanding of the legal framework and arbitration practices in Vietnam.
On the same afternoon, Mr. Vu Anh Duong, on behalf of VIAC, delivered remarks at the thematic seminar organised by NO&T, with a focus on the topic of dispute resolution through arbitration and highlighting key considerations when engaging in arbitration proceedings and effectively managing disputes. The seminar attracted over 50 participants, including representatives from various Japanese enterprises across different industries that were interested in learning more about VIAC and the benefits of resolving disputes through arbitration at VIAC.
Mr. Vũ Ánh Dương – Permanent Vice President cum Secretary General of Vietnam International Arbitration Centre (VIAC) – presenting at the thematic seminar.
During the seminar, Mr. Duong stated that Japan has always been one of Vietnam’s most important partners, and that the Vietnam-Japan relationship is currently at its most favourable point in history. Japan consistently ranks among Vietnam’s largest trading partners and foreign investors. Moreover, Japanese enterprises not only contribute significant investment capital but also transfer advanced technology, modern management methods, and highly efficient production models to Vietnam. However, despite being one of the largest foreign investors in Vietnam, the proportion of disputes involving Japanese companies resolved at VIAC remains relatively low compared to those from other countries. This indicates that Japanese enterprises tend to be among the least likely to encounter disputes, compared to their counterparts from other nations.
Additionally, Mr. Duong shared insights on the legal framework for commercial arbitration in Vietnam to Japanese businesses, underlining key legal documents, including the Law on Commercial Arbitration 2010, along with other relevant legislation such as the 2015 Civil Procedure Code, Law on Electronic Transactions 2023, Land Law 2024, and Resolution 81/2025/UBTVQH15, among others.
He went on to emphasize the pioneering role of VIAC – Vietnam’s first and leading commercial arbitration centre, based on its dispute resolution services and statistics. Since 1993, VIAC has handled nearly 3,400 disputes, with the most common sectors being the sale of goods (39.7%), construction (16.3%), as well as leasing, real estate, insurance, finance, and others. Statistics also show that Japan ranks eighth among the countries most frequently involved in disputes at VIAC.
