VIAC and HCMC University of Economics and Finance (UEF) signed a Memorandum of Understanding and successfully co-organized the Workshop “Strategies for enhancing time efficiency through the combination of Arbitration and Mediation”

Continuing the first Workshop of the AMS 2025 series, on the morning of March 21, 2025, Workshop 02 “Strategies for enhancing time efficiency through the combination of Arbitration and Mediation” was held under the joint coordination of Vietnam International Arbitration Centre (VIAC) and HCMC University of Economics and Finance (UEF). The Workshop attracted the participation of over 150 delegates, including a significant number of arbitrators, mediators, lawyers, in-house counsels, and legal professionals.

Representing the HCMC University of Economics and Finance (UEF), Mr. Do Quoc Anh - Vice Chairman, Board of Directors of the school delivered a welcoming speech. According to Mr. Quoc Anh, the dynamic economic landscape and the continuously increasing deep and expanding international integration present both development opportunities and unpredictable challenges for enterprises. In such a context, disputes arising during contract performance are often inevitable. Mr. Quốc Anh underscored, in order for businesses to swiftly regain stability, overcome obstacles, and refocus their resources on business and investment activities, choosing an appropriate dispute resolution mechanism is of paramount importance, offering both time and cost efficiency. Hence, Mr. Quốc Anh evaluated the practical significance of the Workshop, noting its potential to deliver valuable insights for businesses. Additionally, he underscored the strong collaboration between UEF and VIAC in organizing the event, voicing his hope for an increasingly profound and expansive partnership between the two institutions moving forward.

Representing the Vietnam International Arbitration Centre (VIAC), Prof. Dr. Le Hong Hanh - President of Vietnam International Arbitration Centre (VIAC), delivered the opening remarks of the Workshop. Through the speech, Prof. Le Hong Hanh underscored the importance of ensuring the efficiency of dispute resolution processes, especially in terms of expediency, amidst the increasing number and complexity of commercial disputes. He affirmed that time optimizing in dispute resolution not only helps businesses reduce costs but also contributes to enhancing the competitiveness of Vietnam’s business environment in the international arena. Upon such context, Prof. Le Hong Hanh assessed that businesses are increasingly demanding more flexible and effective resolution methods. Among them, the arbitration – mediation hybrid model has been widely adopted around the world as a “comprehensive solution”. Prof. Le Hong Hanh also mentioned the role of the Vietnam Mediation Centre (VMC) – an affiliated unit of VIAC, established in 2018, with the mission to provide professional commercial mediation services, thereby enabling enterprises to access a more amicable, cost-effective, and efficient method of dispute resolution. Through the integration of arbitration and mediation, VIAC and VMC are progressively developing a comprehensive and seamless dispute resolution mechanism, helping businesses both protect their legal interests and maintain long-term cooperative relationships. Prof. Hạnh expected the Workshop would serve as a platform for experts, businesses, and the academic community to engage in in-depth discussions and practical experience sharing, thereby generating concrete proposals to improve the legal framework and promote the adoption of the arbitration – mediation hybrid model in Vietnam.

At the Workshop, the Vietnam International Arbitration Centre (VIAC) and the University of Economics and Finance Ho Chi Minh City (UEF) also signed a cooperation agreement (Memorandum of Understanding - MOU), marking a significant milestone and ushering in a new stage of development in their partnership. This agreement reflects a shared commitment between VIAC and UEF that generates practical value, not only in academic research but also in practical application. Accordingly, VIAC and UEF will continue to collaborate to develop and implement a wide range of activities aimed at providing valuable information to the business community, legal practitioners, and academia. In addition, the partnership will facilitate closer engagement for students with the practical aspects of resolving commercial and business disputes.

Commencing the Workshop, Mr. Dang Viet Anh - Managing partner of ANHISA Law Firm, Arbitrator of VIAC, Mediator of VMC analyzed the tendency of the arbitration - mediation hybrid model in the resolution of commercial disputes in both Vietnam and internationally. In the context of globalization, the demand for efficient, prompt, and cost-effective dispute resolution mechanisms has grown significantly. While arbitration offers binding enforceability, it tends to be more costly; mediation, on the other hand, is flexible, confidential, and conducive to preserving business relationships, yet relies heavily on the parties’ willingness to comply with the outcome. Stem from such conditions, many international arbitration institutions such as ICC, LCIA, SIAC, and VIAC have developed hybrid models that combine both mechanisms to leverage their respective strengths. Lawyer Viet Anh noted that in Vietnam, the LCA 2010 and VIAC Rules of Arbitration have laid a legal foundation for this combined approach. However, to maximize its effectiveness, Mr. Viet Anh also advised parties to appoint an independent mediator to ensure objectivity and facilitate a smoother mediation process. When properly implemented, this combination can help save time and costs, increase the enforceability of settlements, and foster the broader adoption of this model in Vietnam in the future.

At the Workshop, Ms. Hoang Nguyen Ha Quyen - Managing Partner of LNT & Partners, Arbitrator of VIAC, Mediator of VMC, presented a panel titled “Enhancing time efficiency by switching between arbitration and mediation: Practical applications and arising issues”. Analyzing the arbitration - mediation hybrid model on following factors: (i) mediation prior to arbitration proceedings, (ii) mediation during the arbitration process, and (iii) mediation conducted in parallel with arbitration, Ms. Quyên assessed that while each model presents distinct advantages, they also carry inherent risks and may even backfire if not properly implemented. By referencing specific scenarios and practical issues raised, she advised business to carefully consider when selecting a mediation - arbitration hybrid model, therefore maximize the benefits of switching or combining the two mechanisms by evaluate factors such as the willingness of the parties to amicably resolve the dispute, the complexity of the case, the development stage of the dispute, or depending on the company’s strategies.

At the Workshop, Ms. Ngo Quynh Anh – Managing Partner of EPLegal LLC and Mediator of VICMC – delivered a presentation on “Defining roles and selection criteria for arbitrators and mediators in the integration of multiple dispute resolution methods”. Her talk clarified key considerations when choosing suitable professionals under the arbitration – mediation hybrid model. According to Ms. Quỳnh Anh, Vietnam legal framework currently lacks specific provisions on the qualifications and standards for arbitrators and mediators. This creates difficulties for disputing parties when making selections, hence, she highlighted two prominent issues including role conflicts between arbitrators and mediators when the same individual is appointed to both functions, and the shortage of highly qualified professionals capable of effectively fulfilling both roles. Stem from international practices in Australia and Hong Kong, Ms. Quỳnh Anh proposed that Vietnam should develop detailed legal criteria for selecting arbitrators and mediators. In addition, she called for the establishment of a mechanism to ensure neutrality and prevent conflicts of interest, as a step toward improving Vietnam’s arbitration legal framework. Beyond legal reform recommendations, she also offered practical guidance for disputing parties on selecting the right professionals in a hybrid dispute resolution approach. In particular, she suggested that parties should do a pre-agreeing on role-switching procedures, and appoint independent arbitrators or mediators to safeguard the objectivity and integrity of the dispute resolution process.

To optimize the effectiveness of the arbitration – mediation hybrid model, Assoc. Prof. Dr. Duong Anh Son – Dean of the Faculty of Law, University of Economic – Finance; Arbitrator of VIAC, advised that businesses should focus on drafting multi-tiered dispute resolution clauses, creating flexibility in choosing settlement methods appropriate for each stage of the dispute. According to Dr. Sơn, one of the key issues that businesses should prioritize is the power to resolve the dispute. Accordingly, the parties should clearly specify the dispute resolution mechanism in the commercial contract in order to avoid falling into situations where the arbitration agreement is invalid under the provisions of the LCA 2010 and Resolution No. 01/2014/NQ-HDTP. In cases where the parties intend to adopt the arbitration–mediation hybrid model, the dispute resolution clauses must also clearly stipulate the sequence of dispute resolution steps. For instance, it might be requiring the parties to undergo mediation before initiating arbitration (multi-tiered dispute resolution clause), or allow the parties to suspend arbitration proceedings to conduct mediation when necessary. In addition, the mechanism for transitioning between the two methods should also be clearly identified. For example: will the parties need to suspend mediation in order to proceed with arbitration? What is the maximum time allowed for each stage to avoid prolonged proceedings? How will the costs of the process be allocated?. Dr. Son also advised that businesses should choose reputable arbitration – mediation institutions with experience in operating arbitration – mediation hybrid models, such as VIAC and VMC, to ensure effectiveness.

 
 
 
Following the presentations by the speakers, Mr. Phan Trong Dat – Acting Director of Vietnam Mediation Center (VMC) and Lawyer Chau Viet Bac – Vice Secretary General of Vietnam International Arbitration Centre (VIAC) – jointly moderated the discussion session, which fostered a lively exchange among experts, arbitrators, lawyers, and other participants. The discussion extended beyond strategies for optimizing dispute resolution timeframes, delving into the necessary improvements to enhance the legal framework governing arbitration and mediation, examined from multiple perspectives. This is also a chance for stakeholders to share practical experiences, engage in dialogue about the challenges and opportunities in applying hybrid dispute resolution methods, and propose pragmatic recommendations aimed at fostering the sustainable development of dispute resolution mechanisms in Vietnam.
